Warehouse worker wins claim for compensation after slipping on spillage

A 25-year-old Warehouse Operative whose duties included deciphering orders and assisting in the loading of lorries using folk lift trucks and cherry pickers slipped on a wine spillage thus sustaining a painful injury.
Our client’s employers had strict procedures regarding any breakages, all broken glass to be picked up and suitably disposed of and all spillages to be wiped up. However, towards the end of his shift, the client slipped on a puddle of wine, which had not been cleared up. There were no cones alerting to the wet floor hazard. The client stumbled and went over on his right foot.
There was no immediate pain, however after an hour the client felt his right foot and ankle tightening and on taking his boot and sock off noticed swelling to the area. After several hours bruising became noticeable and the client found it increasingly to difficult to weight bear. Eventually his partner took him to the A&E department of the hospital where he undertook a series of X-rays. The results of the X-ray indicated severe ligament damage to the right ankle and damage to the Achilles tendon. A plaster cast was applied from the toes to the knee.
The client although eager to return to work, was in too much pain. After several weeks, the increase burden of not being able to work and the financial pressure of not receiving a wage coupled with his inability to help around the home and play the sport he excelled in resulted in having a detrimental effect on both his personal and recreational life. The client undertook weekly physiotherapy and although the treatment helped, the limp was still pronounced and the client became increasingly worried about his position within the company.
The client contacted our solicitors looking for help and guidance and they successfully completed the client’s claim for compensation at not cost to the client.
