An explanation of a No Win No Fee Claim |
 |
| No Win No Fee Claim is a phrase many people are now familiar with but what does it actually mean?. |
 |
| No Win No Fee is essentially a term used to describe an agreement
between a firm of solicitors and their client. This agreement is known as a Conditional Fee Agreement (CFA)
and was first introduced in July 1995 in England and Wales to sit along side legal aid. |
 |
| In Personal Injury cases The No Win No Fee Conditional Fee Agreement
has now replaced legal aid allowing client’s access to justice at no financial cost to themselves.
That is to say, if the client loses their no win no fee claim there is simply nothing to pay thus
diminishing the risk of making a claim for compensation. |
 |
| If the no win no fee claim is won, the
client still pays nothing and receives the entire 100% compensation awarded. On winning the case,
the losing party’s insurer/defender’s insurer will be required to pay all the costs the solicitors
have incurred on top of any compensation awarded to the client. |
