Fabricator successfully claimed compensation after suffering a back injury at work |

| The employee claimed compensation for an injury at work. The employee worked as a
fabricator and had a pre-existing back problem. Unfortunately he suffered a further injury to his back
whilst involved in heavy pushing at work. |

| The claim for compensation from his employees for the injury to his back included
an initial two days absence from work. Upon returning to work, it was apparent his back injury had not
recovered and he subsequently had a further week’s absence from work. When the employee returned to work
his employers made adjustments, giving him lighter work and he finally
recovered after six to eight weeks. |

| The difficulty in claiming compensation for the employee’s injury was that just
before his injury he had already had a ‘flare up’ of his pre-existing back condition. It was possible for
the employers’ insurers to dispute the compensation upon the basis that the injury was work related, due
to the pre-existing condition, and that any compensation should be nil or negligible but the
employers’ insurers agreed to pay £1,100 compensation. |
